Selectmen's Minutes - April 13, 1993

Chairman announced the Board received a letter from Town Counsel that the courts were dismissing the Leon Wagner suit and there was a 30 day appeal period that had already commenced.  

The Board agreed that next week agenda they would set April 22, 1993 as the 12th Annual Girl Scout Leaders Day.

Chairman read letter to the Board of Selectmen from Marston Realty Trust thanking the Treasurer/Collector for her assistance.  Motion by Andrews, 2nd Frisoli, 5-0 vote to place letter in her file.  

Chairman announced that the Joint labor Management Commission has named Elizabeth Laing as the mediator for Police Selectman negotiations.

Board voted on motion by Andrews, 2nd Crowley to appoint Robert Woodbury as the Interim Plumbing/Gas Inspector.  Effective April 19, 1993 based on the recommendation of Robert Grover the Building Inspector.  On the same vote they also accepted the leave of absence requested by Gas Inspector Salvatore Sansone for approximately 3 months.  

Motion by Andrews, 2nd Frisoli to grant the Sunday License for sale of ice cream etc. on Sundays to each of the applicants as read by the Chair.  5-0 vote.

Motion by Andrews, 2nd Crowley to reappoint Elizabeth Waterman as Registrar of Voters, term to expire March 31, 1996.  5-0 vote.

Motion by Andrews, 2nd Crowley to vote a common victualer license for the spaghetti dinner May 8 at Camp Kiwanee between the hours of 5 and 8 p.m. to include a one day beer and wine license per request of Frank Gerraughty.  5-0 vote.  

Board approved motion by Crowley, 2nd Andrews to meet every two weeks after town meeting on May 11, 25th, June 8, 22nd, July 13th and 27th, August 10 and 24th.  5-0 vote.  Chairman stated he would look to poll the Board to continue a two week meeting schedule after the summer.  

Board met with the police Chief to discuss his performance evaluation.  Chairman explained that the evaluations were done by each Board member, then totaled and the Chief's total evaluation was 152 divided by 5 , which gave him an evaluation of 30.40.  According to the salary range scale, his range would be between a 4.41 percent and 4.55 percent increase.  The Chairman read the comments and asked for any reply from the Chief.  The Chief did reply to a comment that said he did not have necessary Criminal Justice courses required by statute by Massachusetts to make an arrest.  He stated that that comment was incorrect and should be corrected and said that he would provide proof to the Board.  Selectman Crowley stated that the evaluation process comment concerning the certification of the Chief should not have been placed in the evaluation package if it were not true.  If inaccurate the Board will vote to strike.  

Board then met with Executive Secretary and reviewed his evaluation scores.  Total score of 157 and evaluation score of 31.4 which averages between 4.5 percent and 4.6 percent.  Mr. Nugent addressed the need to react to requests in a more timely manner and must improve communications with Selectmen other than the Chairman.  Board requested Employees make any comments in writing.

Board met with the Wage and Personnel Board.  The Chairman, stated that the Board had been requested over the past couple of weeks to remove the Treasurer/Collector and Town Accountant from Wage and personnel.  Acting upon those requests the Board was asking if it were possible to hold a Wage and personnel Hearing.  Wage and Personnel pointed out that according to the bylaw a hearing has to take place two weeks prior to the close of the warrant.  There fore they felt it would be difficult to go against the bylaw and hold a hearing on these two issue.  The w and P members felt that they would not be able to act on this issue for the May Special Town Meeting.  Wage and personnel asked the Selectmen if they had any questions regarding the articles on the warrant.  The Board responded that they would review all warrant articles at their meeting on April 27.   The Board asked for the Wage and personnel for offering 5% increases.  W and p members commented that they were looking at a salary range of up to 5% increases based on salary surveys both in other Towns and within our community.  Board had several minutes of discussion concerning this issue during which W and P explained their view on the new positions requested and responded to concerns regarding the call firefighters.  The Board made a comment concerning the Patriot Ledger article which seemed to infer there was going to be a volatile meeting between Wage and Personnel and the Board.  Selectmen stated that was not their reason for meeting with Wage and Personnel.  Wage and Personnel Board also explained that they are in the process of creating an evaluation tool and will get a copy to the Board for their comments prior to final acceptance.  

Request to enter exec. session, Motion by Frisoli, second by  Crowley under #3, for negotiations for Clerical, Fire and for litigation regarding the E. Bridgewater Planning Board issue.  Roll Call vote, 5-0, Andrews with reservation.
